PIPA Privacy Notice

This Privacy Policy explains what personal data Cranfields Property Bermuda (‘CPB’) collects, why we collect it, how it is processed, and how you can update, manage, access, and delete your information.

CPB collects the following personal data:
  • Personal identification information (name, email address, phone numbers, etc.)
  • Residential or employment address
  • Employer information (HR contact, job title, income, work permit status and dates)
  • Photographic, audio or visual images or recordings
  • Purchase or sale reasons
  • Source of funds
  • Politically Exposed Person information.

You are not required to provide the Personal Data we have requested. However, we may not be able to provide effective property services to you if you give us incorrect or incomplete information.

Purpose and Use of Personal Data
We collect, hold, process and use your Personal Data for the following purposes:
  • to register you as a customer of CPB
  • to meet the contractual obligations we have entered into with you
  • to review and process any offers you may make to buy or rent a property
  • to process payments, billing and collections
  • to collectinformation about your preferences to improve the quality of our communications with you
  • to comply with our legal and regulatory obligations (including anti-money laundering obligations)
  • to record and monitor your use of our website or our other online services for our business purposes (including analysis of usage, measurement of site performance and generation of marketing reports)
  • for legitimate business interests and purposes (including customer relationship management, reference checks, research, analysis, and other business purposes)
  • to send information about property listings to you
  • to review and respond to any complaints or queries you may have and
  • for other related matters directly related to the relationship between you, the Customer, and CPB.

We may also obtain some of your personal data from publicly available sources (such as media providers, LinkedIn and similar social media platforms, and public registries).

We will keep your Personal Data confidential, and we won’t share it with any other person without your consent, except for the purposes listed in this Notice for which your Personal Data was collected, or if we are required to do so by relevant laws, regulations or professional rules of conduct. CPB does not sell Personal Data to any third-party.

The Personal Data you have given to us will not be used for other purposes, unless:
  • you have expressly given your consent to the use for the relevant other purposes
  • the purpose is directly related to the purpose for which the personal data was collected

Transfer
We may transfer your Personal Data to:
  • our employees and officers
  • any other entity that is controlled by CPB and their employees and officers
  • our external legal advisors
  • other service providers, suppliers, business partners and sub-contractors engaged by us in connection with the operation of our business, but only in so far as it is required for the transaction/s, we have been engaged by you to transact
  • barristers, solicitors, other legal representatives, experts and other service providers engaged acting on our behalf, in order to complete a transaction or seek advice on a transaction, which may include foreign law firms
  • any professional body, regulator, or government body which CPB is required to make disclosure to, as required by applicable laws or regulations or as a matter of professional practice
  • any enforcement authority if required by court order, warrant, or written request
  • companies providing services for anti-money laundering and terrorist financing checks, credit risk reduction, and other fraud and crime prevention purposes.

Access and correction
You have the right to:
  • request a copy of your Personal Data held by us, unless we are exempted from complying with a data access request
  • request us to make necessary corrections to inaccurate information after we have fulfilled a data access requestfrom you. We may refuse a data correction request if we believe the data is accurate, or the suggested correction is not correct.

Our website, bda4sale.com, is intended to provide you with information about properties for sale and or rent in Bermuda.

Cookies

Our website may collect some data as you browse, such as where you are located geographically, what site linked you to ours, or other details such as what time you visited. We collect only data that is necessary for the site to function.

This data is used for statistics, to report on the activity on our website and cannot identify you in person, i.e. it is anonymized data.

If you complete the online form asking us to contact you about a property or for more information, we receive only the information you provide – name, email, telephone number, what you are interested in and a short message you may have provided to us to assist us in helping you. This information will not be shared outside of CPB and will only be used by CPB or CPB consultants to contact you directly.

We may ask you to review your experience with CPB and these comments may be used on our review pages but will never show your name or any personal identifying information on this page.

Section 34 of the Personal Information Protection Act 2016 (PIPA) requires that we keep any information confidential, except as necessary to perform tasks such as answering any questions or comments you may have sent to us. CPB only collect, use, and disclose the minimum amount of information necessary to perform our duties.

Links and social media
Our website may contain links to other sites, particularly to other public entities' sites or to social media sites. These websites have their own privacy policies that may be different from bda4sale.com. If you choose to follow these links, please remember to check the Privacy Notices at those sites.
